Surprise!

I got surprise laid-off this morning.

Came in at nine-ish as usual, ready for my first day back after vacation, to hear that they want to hire an office manager instead of an assistant (me), and that I should go pack my stuff, and here's two weeks severance.

No notice, no warning signs, nothing. And one month before I'm eligible for unemployment from them.

I'm angry more than sad. I'm relieved that there will be a change but worried about getting along in the immediate future.

Tomorrow I'm going to try to make a deal, tell them to keep their severance and pay my unemployment instead. It's not a lot of money but it will help.

Does anybody know what employers are required to give you when you're laid off? Or, a lawyer?

Oh, man, I'm so so sorry. Hearing stuff like that makes my blood boil, so I can only imagine how angry you are.

I just don't get how heartless some employers can be. They have to KNOW that two weeks severence is a fucking joke and they also have to know that they just made the unemployment deadline. I really hope you can negotiate that.

Thanks for the sympathy - I'm actually not surprised that they've decided to handle it this way. They tend to keep information as secret as possible, even if it hurts the people involved.

The other thing is that they're paying me so little that it's ridiculous that they would even weasel out of paying their part of unemployment. But characteristic.

in ny, they are not even required to give you any severence at all.
sick time & vacation if they owe you any, *is* something they have to give you.
ny is an 'employ at will' state, & they can fire you for no reason & give you shite for it & thats that.
these things i know.
i do not know if they can even pay for your unemployment though, even if you asked.
the gov't will look at the paycheck info & determine that you werent working there long enough to even receive it.
this i am not sure of.

you may be able to collect, it doesn't matter how long you worked at this particular job.

A. To qualify, an individual must meet the following criteria:

-earnings of at least $1,600 in the calendar quarter with the highest earnings in the base period, and
-work and wages in at least two calendar quarters of the base period, and
-total base period wages equal to at least one and one-half times the high quarter earnings.

I hope you find a way to sock it to them. UGH I really am sorry. Having been laid off I know how much it sucks. I didn't even get severance :(

That sucks toes.

I'm not 100% sure, but I think unemployment is like 2/3 of your salary. I don't know how it works, though.

aw, that sucks. but lolamontez is right on about the unemployment, you can still collect as long as you have been working (like she said). do the research, it might be worth it.

I was there full-time for 5 months -- but I was freelancing for them for about a month before. So I am going to check out the stuff that people have posted here and hope I can slip in somehow!

At-will employment is tuberculosis. They dropped the boom once here on Friday the thirteenth, but they NEVER laid people off on their way in to work from vacation. Filthy sons-of-bitches. If you're lucky, the unemployment people will be nice and make your end date retroactive so you can collect sooner.
